Our service agreement and terms for web design and SEO services

Agreement to Terms

By hiring Circle Monkeys Web Design, you agree to these terms on behalf of your company or organization. This agreement covers the design, development, and maintenance of a website on a month-to-month payment basis. If you do not agree to abide by these terms, please do not use our services.

Mutual Responsibilities

Client Responsibilities

  • Provide all necessary text content, images, and information in the requested format.
  • Review work, provide timely feedback, and sign-off approvals.
  • Comply with the agreed payment schedule.

Circle Monkeys Responsibilities

  • Perform services professionally and on time.
  • Maintain confidentiality of all client information.
  • Provide regular updates and strive to meet deadlines, while not being held responsible for delays caused by late client materials or approvals.

Services Description

Our services include, but are not limited to:

  • Website design, layout, and functionality development.
  • Ongoing text, photo, video, and promotion updates.
  • Local SEO, Google My Business setup, and optimization.
  • Hosting, SSL certificate, analytics reporting, and support.
  • Accessibility tools and a standard privacy policy template.
  • One campaign landing page (e.g., Facebook or Google Ads).

Additional Services & Charges:

  • Extra location landing pages: $50/month per location.
  • Expanded service area pages: $25/month per area.
  • Franchise microsites: $100/month (up to 6 pages per microsite).
  • Blog feature: $25/month (includes SEO setup + 2 posts per month; client supplies text/photos).
  • Hourly rate for out-of-scope work: $75/hour.

Project Scope and Limitations

  • Testing will be done on current versions of major browsers (Apple, Google, Microsoft, Mozilla).
  • We do not test on outdated browsers (IE 5, 6, etc.) unless otherwise agreed at additional hourly rates.
  • Third-party plug-ins, scripts, or databases requiring extra fees will be discussed in advance.

Subscription Inclusions

Each Subscription Includes:

  • Website (up to 25 pages; additional pages at extra cost).
  • SEO for local/organic search.
  • Hosting & SSL.
  • Google My Business setup & optimization.
  • Ongoing support, updates, and minor changes.
  • Privacy policy template (non-legal advice).
  • Accessibility statement and tools.
  • Analytics and performance monitoring.

Content and Assets

Text Content

  • Initial text for up to 15 pages (home, service, and service area pages) will be prepared if not supplied.
  • Client must review and verify accuracy. Circle Monkeys is not liable for errors in final text.
  • After launch, clients must supply their own original text for ongoing additions (other than titles/headers).

Photographs

  • Clients may supply digital photos. Stock photography will be used as needed.

Domain & Hosting

  • Websites must be hosted on our designated servers as part of the subscription.
  • Clients must purchase and maintain their own domain name and annual renewals.

Intellectual Property & Copyrights

  • Clients guarantee ownership or usage rights for all provided text, graphics, and media.
  • Upon first payment:
  • Clients own their supplied content and published text.
  • Circle Monkeys retains ownership of design, code, and methodologies, licensed to the client for use only while subscribed.
  • Circle Monkeys may display completed projects in portfolios, articles, or case studies, without sharing confidential client information.

Updates and Change Requests

  • Included updates: text changes, image swaps, promotions, new/deleted pages, and other minor edits.
  • Major design or structural changes are excluded.
  • All change requests must be submitted through our support ticket system (not text messages or direct contacts).
  • Updates require at least 3 business days, though timing may vary by request.

Payment Terms

  • First monthly fee due upfront ($199/month for 1–25 page website).
  • Payments must be made monthly.
  • Accounts past due by 30+ days will result in the website being unpublished until the balance is cleared.

Cancellation

  • Subscriptions are month-to-month unless paid annually (12-month commitment).
  • Cancellation requires 30-day written notice via email (info@circlemonkeys.com).
  • Upon cancellation, hosting ends.
  • Website design remains the property of Circle Monkeys. Client retains rights to supplied text, images, and other assets.

Limitation of Liability

  • Circle Monkeys is not liable for indirect, incidental, special, consequential, or punitive damages.
  • We cannot guarantee error-free functionality at all times.
  • We are not liable for issues relating to client-provided content, including testimonials, service guarantees, or accessibility compliance.

Governing Law

  • This agreement is enforceable under U.S. law. If any provision is deemed invalid, remaining provisions remain enforceable.
