Agreement to Terms

You are hiring Circle Monkeys Web Design & SEO (Circle Monkeys LLC) to design, develop, optimize, host, and maintain your website and online presence under a month-to-month website subscription based on the agreed payment plan.

Mutual Responsibilities

Client Responsibilities

As our customer, you confirm that you have the authority to enter into this agreement on behalf of your company or organization.You agree to provide all information and materials needed to complete your project, including text content, images, videos, logos, and any other requested information, in a timely manner and in the format requested.

You agree to review our work, provide feedback, and approve website designs and revisions promptly.

You also agree to maintain your monthly subscription payments according to the payment schedule outlined in this agreement.

Circle Monkeys Responsibilities

We have the experience and ability to perform the services you require, and we agree to complete them in a professional and timely manner.We will make every reasonable effort to meet project deadlines. However, we cannot be held responsible for delays caused by missing content, delayed approvals, or requested revisions outside the agreed scope of work. We will also maintain the confidentiality of any private business information you provide to us.

Your subscription includes ongoing maintenance, allowing our team to update your website with:

to help keep your website current and performing well.

Multi-Location Services

Your subscription includes one (1) primary business location for $999 per month.

If your business has additional physical locations that require their own local optimization and online management, each additional location may be added for $249 per month, per location.

Each additional location includes ongoing:

Search Engine Optimization (SEO)
AI Search Optimization (AEO/GEO)
Google Business Profile management
Citation management
Local optimization
Website support
Website maintenance

Each location is managed individually to maximize its local online visibility.

Additional Services

Any work requested outside the services included within this subscription may be billed at $75.00 per hour after your approval.

Third-Party Services

If your website requires premium plugins, software licenses, APIs, databases, premium stock photography, or other third-party providers that involve additional costs, those costs will be discussed with you before any charges are incurred.

We test websites using current versions of major browsers including:

We do not guarantee compatibility with outdated or unsupported browsers.

Additional pages, custom functionality, integrations, advanced development, or large content requests may require additional charges.

Your Subscription Does Not Include

Your subscription does not include:

Google Ads management
Facebook or Meta Ads management
CRM management
Employee scheduling systems
Customer databases
Calendar management
Email hosting
Domain registration or renewal fees
Third-party software subscription fees

Intellectual Property & Copyrights

Clients guarantee ownership or usage rights for all provided text, graphics, and media.
Upon first payment:
Clients own their supplied content and published text.
Circle Monkeys retains ownership of design, code, and methodologies, licensed to the client for use only while subscribed.
Circle Monkeys may display completed projects in portfolios, articles, or case studies, without sharing confidential client information.

Updates and Change Requests

Included updates: text changes, image swaps, promotions, new/deleted pages, and other minor edits.
Major design or structural changes are excluded.
All change requests must be submitted through our support ticket system (not text messages or direct contacts).
Updates require at least 3 business days, though timing may vary by request.

Payment Terms

First monthly fee due upfront ($299/month for 1–25 page website).
Payments must be made monthly.
Accounts past due by 30+ days will result in the website being unpublished until the balance is cleared.

Cancellation

Subscriptions are month-to-month unless paid annually (12-month commitment).
Cancellation requires 30-day written notice via email (info@circlemonkeys.com).
Upon cancellation, hosting ends.
Website design remains the property of Circle Monkeys. Client retains rights to supplied text, images, and other assets.

Limitation of Liability

Circle Monkeys is not liable for indirect, incidental, special, consequential, or punitive damages.
We cannot guarantee error-free functionality at all times.
We are not liable for issues relating to client-provided content, including testimonials, service guarantees, or accessibility compliance.

Governing Law

This agreement is enforceable under U.S. law. If any provision is deemed invalid, remaining provisions remain enforceable.
